Apps made available through the App Store or Google Play Store are licensed, not sold, to you. Your license to this App is subject to your prior acceptance of this End User License Agreement ("EULA"). This EULA is a binding legal agreement between you and SoulSayIt Limited ("Application Provider").
Application Provider grants to you a nontransferable license to use the Licensed Application on any mobile devices that you own or control. The terms of this EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Application Provider, unless such upgrade is accompanied by a separate license. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application.
The Licensed Application offers auto-renewable subscriptions.
Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
Auto-Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Management: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
Pricing: The specific price of the subscription is clearly displayed within the application's purchase screen.
The Licensed Application utilizes third-party Artificial Intelligence (AI) services (including but not limited to OpenAI) to provide core functionalities such as text generation and analysis.
Data Transmission: To provide these features, your input data (prompts) will be transmitted to these third-party AI providers.
Purpose: Data is shared solely to process your requests and generate AI responses.
Consent: By using AI-powered features within the app, you explicitly consent to the sharing of your necessary input data with these third-party providers. We do not use your personal data to train these AI models without additional explicit consent.
The Licensed Application allows users to post, share, and view content created by other users ("User Content"). By submitting User Content or by using the app, you agree to the following terms.
Application Provider has a zero tolerance policy for objectionable content and abusive behavior. You agree not to create, upload, post, share, or transmit any content that:
You are solely responsible for all User Content you submit. You represent and warrant that (i) you own all rights necessary to submit such content, and (ii) your User Content does not violate this EULA or any applicable law.
Application Provider reserves the right, but is under no obligation, to review, monitor, modify, or remove any User Content at our sole discretion, with or without notice. We may employ automated tools, human moderators, or third-party services to detect and review potentially objectionable content.
If you encounter objectionable content or abusive behavior, you can report it directly from within the app. Tap the three-dot menu on any user-generated content card and select "Report this wisdom". You will be asked to select a reason for the report (such as spam, harassment, sexual content, violence, hate speech, misinformation, or other) and may optionally provide additional details.
Application Provider commits to the following moderation response policy:
In addition to reporting, you may block any user-generated content from your own view at any time. Once blocked, the content will be immediately and permanently hidden from your feed. Blocking is a personal preference and does not require admin review.
Users who violate this UGC Policy may, at Application Provider's sole discretion, have their accounts suspended or permanently terminated without prior notice. Severe violations (such as content depicting child exploitation, credible threats of violence, or coordinated harassment) may result in immediate, permanent termination on the first offense. Repeat lesser violations will result in escalating consequences.
Application Provider does not endorse User Content posted by users and is not responsible for User Content. We reserve the right to take any action we deem necessary to maintain a safe environment, but we do not guarantee the accuracy, integrity, or quality of User Content.
You agree that Application Provider may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any). Application Provider may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.
This EULA is effective until terminated by you or Application Provider. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms, including but not limited to the User-Generated Content Policy. Upon termination, you must cease all use of the Licensed Application and destroy all copies, full or partial, of the Licensed Application.
The Licensed Application may enable access to Application Provider's and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. Application Provider is not responsible for examining or evaluating the content or accuracy of any third-party External Services. Application Provider reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. APPLICATION PROVIDER HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL APPLICATION PROVIDER BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION OR ARISING OUT OF ANY USER CONTENT POSTED BY OTHER USERS.
In no event shall Application Provider's total liability to you for all damages exceed the amount of fifty dollars ($50.00).
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. By using the Licensed Application, you represent and warrant that you are not located in any U.S.-embargoed country or on any such restricted list.
This Agreement and the relationship between you and Application Provider shall be governed by the laws of Hong Kong, excluding its conflicts of law provisions. You and Application Provider agree to submit to the personal and exclusive jurisdiction of the courts located within Hong Kong to resolve any dispute or claim arising from this Agreement.
Application Provider reserves the right to modify this EULA at any time. Material changes will be communicated through the Licensed Application or via the contact information you provided. Your continued use of the Licensed Application after such changes constitutes your acceptance of the revised EULA.
